By accessing, registering, or using our Site or Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must discontinue use immediately.

Ohtel is an online, location-based marketplace for the hospitality industry. The Platform enables registered and unregistered users to post, browse, and respond to listings related to:

• • Advertisement from Buyer and Seller of hospitality businesses, including but not limited to restaurants, hotels, cafes, food factories, and service-providing institutions.
• • Advertisement of new and used hospitality equipment and related products.
• • Hospitality industry job postings and recruitment opportunities.
• • Advertisements from equipment manufacturers, service providers, and other hospitality-related businesses.

Users may search ad listings based on location, category, price, and other criteria, and may contact listing owners directly through provided contact details or available communication tools.

Ohtel acts solely as an online intermediary that provides the technological means for listing, advertising, and facilitating initial contact between users.

We are not a party to any transaction, negotiation, or agreement between users. We do not:

• • Verify or guarantee the accuracy, completeness, legality, quality, or safety of any listing, product, service, or job posting.
• • Guarantee that a buyer, seller, employer, or applicant will complete a transaction or respond to communications.

All transactions and communications are conducted solely at the risk and responsibility of the parties involved.

We reserve the right to modify, suspend, or discontinue any part of the Services at our sole discretion, without prior notice.

3. User Accounts

When creating an account, you agree to:

• 1. Provide accurate, complete, and up-to-date information.
• 2. Maintain the confidentiality of your login credentials.
• 3. Accept full responsibility for all activities under your account.

We reserve the right to remove any content or terminate any account that violates this clause without notice, and to cooperate with law enforcement authorities where required.

If, notwithstanding the above, Ohtel is found liable for any claim, our total liability shall not exceed the amount paid by you (if any) for the specific service in question during the three months preceding the claim.

You agree to indemnify, defend, and hold harmless Ohtel, its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to:

11. Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, the Site, or the Services shall first be attempted to be resolved through good-faith negotiations between the parties.

If the dispute is not resolved within thirty days, it shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a single arbitrator appointed jointly by the parties. If the parties cannot agree, the arbitrator shall be appointed by the competent court in Hubli.

The place of arbitration shall be Hubli, Karnataka, and the language of the proceedings shall be English. The decision of the arbitrator shall be final and binding on both parties.

Nothing in this clause shall prevent either party from seeking interim relief from a court of competent jurisdiction.

12. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using our Services, you consent to the collection and use of your data in accordance with the Privacy Policy.

13. Changes to Terms

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India. All disputes, including arbitration-related matters, shall be subject to the exclusive jurisdiction of the courts located in Hubli, Karnataka.
